Terms and Conditions – Online English Language Instruction

Agreement & Binding Acceptance

These Terms and Conditions (‘Terms’) constitute a legally binding agreement between Brent Welburn (‘the Teacher’) and the student (‘the Student’) from the moment a lesson is booked. By booking a lesson, the Student confirms they have read, understood, and unconditionally agreed to these Terms in full.

Booking, Payment & Packages

The following terms govern all bookings and payments:

  • Lessons must be booked a minimum of 48 hours in advance unless otherwise agreed in writing.
  • Full payment is required at the time of booking. No lesson is confirmed until payment is received.
  • Accepted payment methods: website payment system, or as otherwise agreed in writing (e.g. PayPal, Wise, bank transfer, Stripe).
  • All lesson packages are non-refundable once purchased and must be used within 3 months of the purchase date.
  • Unused lessons after the 3-month period are forfeited without refund, transfer, or exchange.
  • Prices are subject to change with a minimum of 30 days’ written notice.

Cancellation, Rescheduling & Lateness

  • More than 24 hours’ notice: A complimentary reschedule is offered at a mutually convenient time.
  • Less than 24 hours’ notice: The full lesson fee is forfeited. No refund or reschedule will be provided.
  • No-show (no contact before the scheduled start time): The full lesson fee is charged and forfeited without exception.
  • Where the Teacher must cancel, the Student will receive a full reschedule or refund for that specific lesson.
  • A Student who is more than 15 minutes late without prior notice will be treated as a no-show and the full lesson fee forfeited.
  • Where the Teacher is late, the lesson will be extended by equivalent time or a replacement lesson offered.

Safeguarding & Protection of Minor Students

  • A completed and signed Parental/Guardian Consent Form must be submitted to learn@brentwelburn.com before any lesson involving a student under 18 can commence.
  • A parent or guardian must be present throughout all lessons with students under the age of 13.
  • No direct personal contact between the Teacher and a minor student is permitted outside the designated lesson platform, including via social media, personal messaging, or direct email to the minor.
  • The Teacher reserves the right to terminate any lesson immediately and without refund if the student’s environment is deemed unsafe, unsupervised, or otherwise inappropriate for a minor.
  • Any safeguarding concern identified during a lesson will be handled in accordance with applicable child protection guidelines.

Student Conduct & Online Environment

The Student agrees to maintain professional conduct throughout all lessons and associated communications. Specifically, the Student agrees to:

  • Conduct lessons in a quiet, well-lit, and appropriate environment with a stable internet connection and suitable device.
  • Treat the Teacher with courtesy, respect, and professionalism at all times.
  • Ensure that no uninvited third parties are present during lessons without the Teacher’s prior written consent.
  • Not record, screenshot, or capture any part of a lesson — in audio, video, or any other format — without the Teacher’s explicit prior written consent.
  • Not share, publish, distribute, or post any lesson content, materials, or the Teacher’s image or likeness on any platform without written permission.

Intellectual Property & Confidentiality

All lesson materials, worksheets, resources, lesson plans, and content created or provided by the Teacher are the exclusive intellectual property of Brent Welburn and are protected under applicable copyright law.

Without the Teacher’s prior written consent, the Student may not:

  • Copy, reproduce, modify, or adapt any lesson materials.
  • Distribute, share, publish, sell, or transfer any lesson content to any third party.
  • Use any lesson materials for commercial purposes.

Limitation of Liability & Force Majeure

The Teacher is not responsible for the Student’s failure to progress, achieve specific language goals, or pass any examination. Learning outcomes are dependent upon the Student’s own effort, attendance, consistency, and practice outside of lessons. Tuition is delivered on a professional best-efforts basis.

Neither party shall be held liable for failure to fulfil their obligations where such failure results from circumstances beyond their reasonable control, including but not limited to: serious illness, family emergency, natural disaster, government restrictions, or prolonged technical outage. In such circumstances, the Teacher will offer a reschedule at the earliest reasonable opportunity. Any refund in a force majeure situation is at the Teacher’s sole discretion.

Termination, Disputes & Governing Law

Either party may terminate the tutoring arrangement with reasonable written notice. The Teacher reserves the right to terminate services immediately and without refund in cases of: abusive or threatening behavior; non-payment; breach of any clause of these Terms; or any conduct posing a safeguarding concern.

  • Step 1: The Student raises the concern in writing to learn@brentwelburn.com within 7 days of the incident.
  • Step 2: Both parties attempt good-faith resolution within 14 days.
